Terms of Service

On this day, 2023-07-20, the following policy has been established for preVet.

General

1.1 These general terms and conditions (“the Terms”) govern your use of the information service provided via the website [https://prevet.se/] or (“the Service”) by preVet AB, company registration no. 559107-7655, Sidenvävargatan 17, 753 19 Uppsala, (“preVet”).

1.2 To use the Service, you as a user must be at least 18 years old and/or otherwise legally competent to enter into agreements and accept these Terms and preVet’s privacy and confidentiality policy as set out below. If you are under 18 years of age, your parent or guardian must read and accept these Terms on your behalf. Do not register, install the software, or purchase anything from our website without first having approval from your parent or guardian. By accepting these Terms, you certify that you are 18 years of age or older or that you have permission from your parent or guardian to purchase from our website, subscribe to the Service, and install and use the application.

1.3 By creating an account and using the Service, you consent to and accept the Terms and the Privacy and Confidentiality Policy. This constitutes an agreement between you and preVet regarding the use of the Service and the processing of your personal data for the stated purposes. Therefore, we ask you to read these Terms carefully and thoroughly before you begin using the Service. The way preVet processes your personal data is regulated according to the privacy policy below and constitutes an integral part of these Terms.  

Use of the Service

2.1 When using the Service, you have the opportunity to share information about your pet’s current and historical data with third parties such as veterinarians and other service providers.

2.2 You are responsible for all use of the Service and for protecting your login details against unauthorized access.

2.3 The Service is offered in two different forms: a free variant (“preVet Basic”), and a (“preVet Pro”). By making a payment according to the current price list (including VAT, but excluding any fees charged by your mobile operator or internet provider), you can access additional features [Multiple animals in the app, Attach PDF, Reminder function, Filtering function, Calendar view] in addition to the content provided within preVet Basic. If third-party providers charge fees in connection with your use of preVet Pro, we strive to inform you of this specifically.

2.4 Payment for your use of preVet Pro can be made through the App Store or Google Play. Note that the payment service provider applies separate terms for the use of their services, so we urge you to read these carefully.

2.5 preVet may also offer you new services within the Service. Such new services may be subject to specific terms. If you wish to activate the new service, you must accept the specific terms applicable to that service.

2.6 preVet and its partners and advertisers in ad networks may target offers to you via the Service, email, or otherwise. Direct marketing must comply with applicable laws, codes of conduct, and ethical guidelines. If you have opted for this but no longer wish to receive targeted offers, you can contact us as outlined in point 9.1 below. The Service may also contain links to or offers from external partners who have different terms than preVet. You are urged to familiarize yourself with these terms.

2.7 preVet may anonymize and de-identify data that is registered in the Service and use this for, among other things, statistics, personalization, market analyses, and user behavior analyses. Such data may also be transferred to our partners for research purposes. By entering into an agreement about the use of the Service, you have given an informed consent/approval for the data you register to be de-identified and anonymized and used for these purposes.

Intellectual Property Rights

3.1 preVet owns all intellectual property rights such as trademarks, copyrights, patents, and know-how to the Service provided to the customer.

3.2 It is not permitted to copy, modify, distribute, or publish content provided by preVet. However, for personal use, it is permitted to download, copy, and save information from preVet. It is also not allowed to misuse offers or otherwise abuse the Service.

3.3 You are responsible for and hereby guarantee that the information you upload or input into the Service does not infringe anyone else’s rights or otherwise violate any law or another’s rights.

Personal Data

4.1 By creating a preVet account, you agree that preVet processes personal data according to the procedures set out in preVet’s privacy and confidentiality policy and that preVet stores and processes the information for the purposes set out in the privacy and confidentiality policy.

preVet’s Responsibility for the Service

5.1 preVet has the right to terminate your account at any time if you violate the Terms or otherwise use the Service in a way that may cause damage to preVet or third parties.

5.2 preVet intends that all information in the Service is accurate and as updated as possible. However, preVet cannot guarantee the availability of the Service or the reliability or accuracy of the information presented in the Service. preVet cannot be held responsible if the Service is down or if any information or functionality does not work as expected.

5.3 preVet shall have no liability for any financial or other decisions you make based on the use of the Service or for services or goods you choose to purchase from independent third parties or preVet’s partners.

5.4 A party is not responsible for delays or loss due to circumstances beyond the party’s control that significantly impede the fulfillment of the obligation in question or make the fulfillment of the obligation economically indefensible.

5.5 preVet has the right to change the Service, modify the Terms, or cease providing the Service at any time. preVet will notify you with reasonable notice of any changes to the Terms. If you do not accept the amended Terms, you have the right to terminate your agreement with preVet before the amended Terms take effect. You terminate the agreement with preVet by closing your account and subscription with preVet, see sections 6.1 and 6.2.

Termination of Your Account

6.1 You may at any time terminate your account and your use of the Service by selecting “Delete Account” or similar function in the Service or by contacting preVet according to the contact information below in section 9.1. preVet will then delete your entire account and all data in the account including personal data, however with the exception of such data that preVet is required by law to save and data that has been de-identified and/or anonymised for research purposes. 6.2 You terminate your subscription (preVet Pro) via a third party (App Store or Google Play).

Assignment

7.1 preVet has the right to transfer its rights and obligations under these Terms. Furthermore, PreVet has the right to hire subcontractors to fulfil its obligations. Such subcontractors are in some cases preVet’s data processors, read more about this in our Privacy and Confidentiality Policy.

Dispute

8.1 Any dispute arising out of the Terms or your use of the Service shall be settled under Swedish law and by a Swedish court.

Privacy and Confidentiality Policy

On this day, 2023-07-20, the following policy has been established for preVet.

1.1 This Privacy and Confidentiality Policy (“The Policy”) applies when preVet AB, corporate ID no. 559107-7655, Sidenvävargatan 17, 753 19 Uppsala, (“preVet”) provides services through a website or app (“The Service”).

1.2 To use The Service, you must be at least 18 years old and/or otherwise authorised to enter into contracts and accept our general terms and conditions, thereby also accepting this Policy. If you are under 18, your parent or legal guardian must read and accept the general terms and conditions on your behalf. Do not register, do not install the software, and do not purchase anything from our website before you first have approval from your parent or guardian. By accepting the general terms and conditions, you are affirming that you are 18 or older or that you have permission from your parent or guardian to make purchases from our website, subscribe to The Service, and install and use the application.

1.3 By creating an account and using The Service, you agree and accept that preVet collects and submits information on your mobile phone, tablet or other equipment, and processes your personal data in accordance with this policy. In order for preVet to provide The Service, by using The Service, you also agree to have data as per points 2.1, 2.2, and other data relating to your routines regarding animal care that you have let preVet access, including that you have a contract with preVet, processed and disclosed to preVet’s partners in accordance with point 4.2.

1.4 You can terminate your agreement with us at any time by closing your account with preVet. You can close your account by choosing “Delete Account” or a similar function in The Service or by contacting preVet as per the contact information below in point 9.1. preVet will then delete and/or de-identify or anonymise information that can be attributed to you, with certain exceptions in accordance with point 2.3 below.

Collection and Processing of Personal Data

2.1 preVet collects and processes personal data about you when you create your account and use The Service. The personal data collected is your contact details such as name, address, username, email and phone number, information about IP address and location data, Firebase Cloud Messaging token, and information about your animal(s) such as name, age, breed, colour, and chip and registration number. When purchasing the app and/or subscribing to the app, information about purchase transactions (amount, time, type of transaction and any goods) is also collected by third parties (AppStore/Apple Inc and Google Play). preVet is not responsible for such third parties’ processing of your personal data. preVet also collects information through its own or third party cookies and other tracking tools, see point 7.

2.2 preVet primarily gets access to personal data and other data by you registering these directly in The Service. We may also get access to data via third parties, such as veterinarians and farriers. preVet may also send data from The Service about you and your animal(s) to such third parties. The transfer of such data to or from preVet only occurs after an active request from you.

2.3 Your personal data is only stored as long as it is necessary and there is a need to preserve them in order to fulfil the purposes for which the data was collected. You can close your account by choosing “Delete Account” or a similar function in The Service or by contacting preVet as per the contact details below in point 10.1. preVet will then delete your entire account and all the data in that account including personal data, except for those data that preVet is required by law to save and thus continue to process. preVet may also keep data longer if needed to monitor preVet’s legal interests, e.g. if there is an ongoing legal process.

Why We Process Personal Data

3.1 preVet processes your personal data for several different purposes. Mainly, preVet processes personal data in order to provide, administer, develop and customise The Service and its functionalities, to ensure customer knowledge, to administer the customer relationship with you, and to comply with safety and other regulatory requirements. The data can also serve as a basis for market and customer analyses, market surveys, statistics, business monitoring, and business and method development.

3.2 preVet further processes your personal data to provide better and more personalised offers and service. Personal data and information about location data may, for example, be processed, combined, segmented and analysed to provide information, offers or recommendations about our own or cooperative partners’ products and services, which are tailored to your preferences, behaviours, needs or lifestyle. preVet may also process your personal data so that other users can access your name and email address in connection with various services and features offered within The Service.

3.3 If you do not want preVet to process your personal data for direct marketing, you should notify preVet as per the contact details below in point 9.1.

Legal Grounds for Personal Data Processing

4.1 The company’s contact details, name, email and address are handled based on contract and the general terms and conditions, a legitimate interest, and consent.

4.2 The legal basis for processing customer data within the framework of the service provided is contract (with existing customers) and legitimate interest (with potential customers).

4.3 We also save personal data needed for billing (name, address); here the legal grounds are both contract and legal obligation.

4.4 To be able to save customers’ personal data, we ask for the customers’ consent. Consent is obtained by the customer accepting the general terms and conditions and the privacy policy. A customer may only consent if the customer is 13 years old or older, otherwise the customer must ask their parents to consent. Consent can always be withdrawn. We then delete the customer’s personal data. We also do this if the customer deregisters.

Disclosure and Transfer of Data

5.1 preVet may disclose or otherwise provide information about and handling of your animal(s) to preVet’s partners for research purposes. However, you should be confident that preVet’s partners will not, except in the cases described in 4.2 below, be able to identify you or your animal(s), as the information disclosed is de-identified and anonymised and therefore does not contain names, social security numbers, registration numbers, other contact information or other personal data. The partner has committed through a contract not to combine the information with other registers in order to reveal your or your animal(s)’ identity. The partner may also not disclose the information to anyone else without preVet’s written approval.

5.2 Personal data may be disclosed if necessary to comply with applicable legal requirements or authorities’ requirements, to protect preVet’s legal interests, or to detect, prevent or draw attention to frauds and other security or technical problems. In some cases, The Service may contain offers from an external partner, e.g. through a link to the partner’s website. If you choose to take advantage of such an offer, as a result, personal data may be transferred between preVet and the relevant partner. Personal data may also be disclosed to a partner in insurance matters. In these cases, the partner is solely responsible for the processing of your personal data. It is always clearly stated in The Service when an offer is provided by someone other than preVet. preVet may also disclose personal data to companies that process personal data on preVet’s behalf, e.g. our IT suppliers, or to suppliers in preVet’s ad network. Such companies become our data processors, see more in point 8.1.

5.3 Your personal data may be transferred to or stored in a country outside the EU/EEA to ensure functionality with e.g. Apple’s and Google Play’s update and subscription function. By creating a preVet account, you accept that your personal data can be processed, transferred and stored outside the EU/EEA. When preVet transfers personal data outside the EU/EEA, this is only done if we have a legal basis for the transfer in accordance with applicable data protection laws and regulations such as the country has an adequate level of protection or that preVet, or our subcontractor, does it with the support of standard contractual clauses (SCC) adopted by the EU Commission. The standard contractual clauses may form a basis for the transfer if both parties have committed to comply with standardised data protection provisions in the contract arrangement.

Changes to The Policy

6.1 preVet has the right to change this Policy at any time. preVet will notify you of upcoming changes to The Policy with reasonable notice via the website or app. If you do not accept the changes to The Policy, you have the right to terminate the agreement with preVet. You terminate the agreement with preVet by closing your account with preVet.

Data Security

7.1 You should always feel safe when you provide your personal data to preVet. Therefore, preVet has taken the necessary security measures to protect your personal data against improper access, alteration and deletion.

Cookies

8.1 preVet’s Services on preVet’s website and in the app use cookies and other technologies (hereinafter “cookies”) to work properly. Cookies are used so that preVet can keep visitor statistics and to improve the experience for you. preVet also collects, analyses and combines information about usage for the purposes stated in point 3. If you do not accept the use of cookies, you can configure your browser not to accept cookies. If you choose to set your browser not to accept cookies, preVet unfortunately cannot guarantee that The Service will work properly.

8.2 When you download preVet’s app on your mobile phone, tablet or other equipment, preVet needs to store and retrieve certain technical information from the equipment in order for preVet to be able to provide and update The Service. By downloading the app, you agree that preVet stores and retrieves certain technical information from the equipment. If you no longer wish for preVet to store and retrieve the technical information, you must uninstall the app.

Rights of the Registered

9.1 preVet is the data controller and is responsible for ensuring that your personal data is processed in accordance with applicable data protection legislation. preVet employs a number of data processors to deliver The Service. On request, you can find out which data processors we employ by contacting us as per point 9.1 below. preVet ensures that all data processors comply with data protection legislation and our Policy and internal procedures and that data processor agreements (DPA-agreements) are signed.

9.2 You have the right, by a signed written application, to receive a register extract about which personal data is registered about you. You have the right to this information free of charge. You also have the right to request that your personal data be corrected or deleted. You also have the right to request that the processing of your personal data be limited or to object to such processing in a manner in accordance with the General Data Protection Regulation or national privacy legislation. After such a request, we evaluate whether there are grounds for the requested change.

9.3 Don’t hesitate to contact preVet if you have any questions about the processing of your personal data or want to request a register extract. Our contact information can be found below in point 10.1

9.4 The Swedish Authority for Privacy Protection (IMY) is the supervisory authority for the processing of personal data and data protection in Sweden. You have the right to file complaints about the processing of personal data to IMY. Contact information for IMY can be found at https://www.imy.se/en/individuals/lodge-a-complaint/
